By accessing or using any service provided by MaskHosting LLC ("MaskHosting," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our services.
These Terms apply to all visitors, users, and customers of MaskHosting services, including but not limited to web hosting, cloud hosting, domain registration, and related services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of our services after any modifications constitutes your acceptance of the new Terms.
You must be at least 18 years of age to use MaskHosting services. By registering, you confirm that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.
You agree to provide accurate, current, and complete information during registration. We reserve the right to suspend accounts that contain false or misleading information.
Each account is for a single user or organisation. You may not share, sell, or transfer your account to any third party without our prior written consent.
You agree to use MaskHosting services only for lawful purposes and in a manner that does not infringe on the rights of others or restrict or inhibit anyone else's use of the service.
The following activities are strictly prohibited and will result in immediate account termination:
Content not prohibited by the above but that generates excessive abuse complaints may still be suspended at our sole discretion with 24-hour notice where possible.
Our offshore servers located in the Netherlands operate under Dutch law. We are not legally obligated to comply with US DMCA takedown notices and will generally ignore them.
However, we do respond to valid Dutch or EU copyright infringement claims that are submitted in accordance with applicable law. Claims must include: (a) identification of the copyrighted work, (b) identification of the infringing material, (c) your contact information, (d) a statement of good faith belief, and (e) your signature.
MaskHosting reserves the right to remove content or terminate accounts that are subject to repeated, credible infringement complaints even from non-Dutch jurisdictions, at our sole discretion.
For DMCA notices related to our US-based servers, send written notification to: billing@maskhosting.com
All fees are due in advance. Services are activated upon receipt of payment. Prices are listed in US dollars (USD) and are subject to change with 30 days' notice.
Auto-renewal is enabled by default for all services. You will receive an invoice at least 14 days before each renewal. You may disable auto-renewal at any time via your client area.
We offer a 30-day money-back guarantee on all hosting plans. Refund requests must be submitted within 30 days of the original purchase date. Domain registrations, renewals, and SSL certificates are non-refundable.
Failed payments may result in service suspension after 14 days and account termination after 30 days. A $5 USD reactivation fee may apply for suspended accounts.
Chargebacks filed without prior contact with our billing department will result in immediate account termination and may be referred for debt collection.
MaskHosting guarantees 99.9% network uptime per calendar month (excluding scheduled maintenance). This equates to a maximum of 43.8 minutes of unplanned downtime per month.
If uptime falls below 99.9% in any given month, you may request a service credit equal to one (1) day of service for each hour of excess downtime, up to a maximum of thirty (30) days' credit.
Downtime caused by: (a) customer actions or misconfigured scripts, (b) scheduled maintenance with prior notice, (c) force majeure events, or (d) DDoS attacks exceeding our mitigation capacity, are excluded from the SLA calculation.
Service credits are the sole remedy for SLA breaches and must be requested within 7 days of the incident by submitting a support ticket.
We are committed to protecting your privacy. Our Privacy Policy, incorporated herein by reference, describes how we collect, use, and protect your personal data.
We do not sell, trade, or rent your personal information to third parties. We may share data with trusted service providers (e.g., payment processors) strictly as necessary to deliver our services.
For offshore plans, your account data is stored on servers in the Netherlands governed by Dutch/EU law (GDPR). We will not disclose user data to US authorities unless required to do so by valid Dutch or EU legal process.
MaskHosting may terminate or suspend your account at any time for violation of these Terms, with or without prior notice depending on severity.
You may cancel your account at any time through your client area. Cancellations take effect at the end of the current billing period. No refunds are issued for unused portions of a billing period unless within the 30-day money-back window.
Upon termination, your data will be deleted within 30 days. We strongly recommend taking a full backup before cancelling your account.
Accounts terminated for Terms violations (e.g., prohibited content) are not eligible for refunds.
MaskHosting services are provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement.
To the maximum extent permitted by applicable law, MaskHosting's total liability to you for any claim arising from or related to these Terms shall not exceed the total amount you paid to us in the three (3) months preceding the claim.
MaskHosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunity.
These Terms are governed by the laws of the Netherlands for offshore hosting accounts, and by the laws of the State of Delaware, USA for accounts on US-based servers, without regard to conflict of law provisions.
Any disputes arising from these Terms shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration.
You waive any right to participate in a class-action lawsuit or class-wide arbitration against MaskHosting.
